These Terms of Service (“Terms”) govern your access to and use of the Access Fire Solutions website, the Learning Management System (LMS), 360-degree virtual tours, AI-assisted evaluation tools, digital templates, and any associated services (collectively, the “Services”). These Terms form a binding legal agreement between you (“User”, “you”, “your”) and Access Fire Solutions (“AFS”, “we”, “our”).
PLEASE READ THESE TERMS CAREFULLY. By accessing, browsing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Refund Policy. If you do not agree, you must not use the Services.
1. Definitions
- “Account” refers to the unique user profile created to access the AFS LMS.
- “Content” refers to all course materials, 360-degree tours, videos, text, and assessments provided within the LMS.
- “Digital Templates” refers to downloadable documents, Fire Safety Plans, and checklists purchased through our store.
- “AI Evaluation Tools” refers to the interactive video and artificial intelligence systems used to simulate field inspections and evaluate communication skills.
2. License and Permitted Use
AFS grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services solely for your personal educational and professional development.
Regarding Digital Products : If you purchase Digital Products (e.g., Fire Safety Plans), you are granted a license to modify and use these documents for your own internal business operations or specific municipal compliance. You are strictly prohibited from reselling, redistributing, or publishing the blank templates commercially.
You agree that you will not:
- Copy, distribute, screen-record, or reproduce any portion of the course Content or 360-degree tours;
- Modify, translate, or create derivative works based on AFS proprietary course materials;
- Share your login credentials with any other individual;
- Use automated tools, bots, or scripts to interact with the Services or bypass course timers.
3. AI-Assisted Evaluations and Video Consent
To meet the Job Performance Requirements (JPRs) of NFPA standards, AFS utilizes advanced AI-assisted simulations.
- By using these specific evaluation tools, you explicitly consent to the recording of your audio and video webcam feed.
- You acknowledge that these recordings are processed by artificial intelligence to generate transcripts and evaluate your communication, tone, and code-citation accuracy.
- These recordings are used strictly for academic grading, certification verification, and quality assurance, in accordance with our Privacy Policy.
4. Honour Code and Academic Integrity
AFS relies on the integrity of all learners to uphold the standards of the fire service and the Safety Codes Act. Users are expected to act honestly when completing modules, virtual externships, and exams.
By using the Services, you agree that:
- You, and only you, will complete your assigned coursework and video evaluations.
- You will not copy, screenshot, distribute, or publish exam questions or answer keys.
- You will not use generative AI tools (e.g., ChatGPT) to bypass or artificially complete written assignments or cognitive exams.
If AFS confirms suspected fraudulent activity, we reserve the right to:
- Revoke your access to the LMS without refund;
- Invalidate any certificates obtained fraudulently;
- Notify your sponsoring employer, municipality, or the relevant provincial accrediting body (e.g., Alberta Firefighter Certification / Safety Codes Council).
5. Certificate Integrity
Certificates of completion generated by AFS are official training records. Any attempt to alter, edit, falsify, or tamper with the formatting, dates, names, or verification details on a certificate is strictly prohibited and will result in immediate permanent bans and reporting to provincial authorities.
6. Purchases, Payments, and Refunds
All purchases made through the AFS platform are processed via secure, PCI-compliant third-party payment gateways (e.g., Stripe, WooCommerce). AFS does not store your credit card information.
All purchases, course transfers, and cancellations are strictly governed by our Refund & Cancellation Policy. By making a purchase, you agree to those terms.
7. Educational Disclaimer (Not Legal Advice)
The Content provided by AFS is for educational and training purposes only. While our curriculum are aligned with national codes, standards and publisher references, AFS does not provide legal advice.
- Codes, standards and municipal bylaws are subject to change and local interpretation by the Authority Having Jurisdiction (AHJ).
- AFS is not liable for any legal repercussions, failed municipal inspections, or property damages resulting from a User’s application or misinterpretation of the educational material in the field.
8. Account Security
You are responsible for maintaining the confidentiality of your username and password. You agree to notify AFS immediately if you suspect unauthorized access to your account. AFS is not liable for any losses resulting from your failure to safeguard your credentials.
9. Limitation of Liability
To the fullest extent permitted by law, AFS, its directors, instructors, and affiliates shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of the Services, including loss of data, loss of employment, or loss of profits.
The maximum aggregate liability of AFS for any claim is strictly limited to the total fees paid by you to AFS in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless AFS from any claims, damages, losses, liabilities, or expenses (including legal fees) resulting from your misuse of the Services, your violation of these Terms, or your violation of any third-party rights.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising out of or relating to these Terms that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts located in Alberta.
12. Updates to These Terms
AFS reserves the right to update these Terms at any time to reflect changes in technology, law, or operational requirements. Revised Terms will be posted on this page with an updated “Last Updated” date. Continued use of the Services constitutes your acceptance of the updated Terms.
